A judge has thrown out a lawsuit by opponents of same-sex marriage against the city’s elections board. The plaintiffs sued after the Board of Elections and Ethics refused to put their initiative, which would have defined marriage as between a man and a woman, on the ballot. The board ruled that it violated the city’s Human Rights Act. Judge Judith N. Macaluso of District of Columbia Superior Court said the board’s action was justified because the initiative would in effect authorize discrimination. The Washington City Council passed a bill last month that would let same-sex couples marry. Because the city is a federal district, the ordinance is pending a period of review by Congress.
